Does Making a Compensation Claim Mean Going to Court?

It’s extremely unlikely, but not impossible. A very high percentage of compensation cases are settled at some point during the legal process. Nobody really wants to end up in court when there is a better option available.

One way of looking at the legal process is to say that it demonstrates intent. In other words, it sends a clear message to the clinician that they are not going to get away with it and that they need to face up to what has happened.

Another important point to remember is that it is not the patient whose conduct is being challenged – it is the dentists. It is virtually impossible to think of a scenario where some blame might lie with the patient. Therefore, even on the very rare occasion where a compensation claim might end up in court, the spotlight would be firmly on the dentist, and not on you.
